Rental Vehicle Management Agreement

1. PURPOSE OF AGREEMENT
This agreement is made between Agent and Owner of the Recreational Vehicle described below. Agent agrees to operate, manage, maintain, and otherwise promote the vehicle for the purpose of renting and leasing for the income benefit of the owner in accordance with the terms and conditions of this agreement.
2. RELATIONSHIP OF PARTIES
It is understood that owner retains full ownership of vehicle, and hereby appoints Capital RV Sales to act as his or her agent as specifically set forth in this agreement.

4. Rental Rates
Agent shall collect rental payments from customers as per agent’s current published rental rate, or as competition permits. Owner agrees to allow Agent to vary the published rate during the year to accommodate special weekend packages, coupon specials, various other promotional offers, or renter discounts. Owner further agrees that in the event that any commissions or discount is paid by Agent, including but not limited to travel agent, airline or credit card companies the amount paid will be paid per compensation sections 7 and 8.
5. OWNERS RESPONSIBILITES ( NEXT PAGE A)
- Owner authorizes Agent to add the above described vehicle to Agent’s master insurance policy for commercial rental coverage. Owner understands that a $500.00 refundable deposit must be given to Agent for the insurance company. This policy names Agent as insured party and Owner as Additional Insured.

Owner will add Capital Service Center Inc. DBA Capital RV Sales to their Insurance Policy as additional insurer. Owner agrees that the vehicle remains owners sole risk, without liability on the part of the dealer for loss hereof, or damage thereto by fire, theft, collision, or other occurrences. Agent (Dealer) will not be responsible for vehicle failures, including, but limited to mechanical, electrical, or appearance.
Owner accepts insurance subject to the terms, conditions, limitations and restriction contained in the actual policy of insurance even though all of them are not set forth in this agreement. The actual master policy is available for Owner’s inspection at Agent’s premises. The policy premiums will be paid by owner. Agent will take reasonable measures including lighted lot and security cameras to prevent vandalism or theft of any kind while vehicle is on Agents premises. However, if such should occur, the deductible will be the owner’s responsibility.
- To allow Agent to maintain vehicle in a constantly attractive, serviceable, and safe condition, a $500.00 refundable accrual fund will be established and maintained through rental income. Owner authorizes Agent, at its sole discretion, to select the repair facility for any mechanical or other repairs. If it is necessary to have warranty, or other repairs, performed at another dealership, or repair facility at Agent’s sole discretion. It is further understood that Agent is not responsible for any lost income to the owner as a result of time lost due to damage, repairs, failure to timely return by renter, or for theft of the vehicle.
- To keep current license tabs on vehicle at all times, purchasing them in advance, if necessary, to correlate with scheduled rentals, or will provide Agent with license renewal forms, and does hereby authorize Agent to purchase tabs. Any cost for emission testing, licensing, or other necessary cost incurred on owner’s behalf shall be reimbursed to Agent. In addition, Agent may assess a charge for it’s time reasonably incurred for performing any emission testing or licensing of the vehicle.
- To book no rentals privately during the period of this agreement, but refer all prospects to Agent.
6. AGENT’S RESPONSIBILITIES
A. To qualify rental customers including:
1. Collecting credit and employment information.
2. Verifying possession of a valid driver’s license.
3. Providing instruction of vehicle operation.
4. Prior to departure, collecting damage and security deposits as well as rental amounts.
B. To inspect vehicle for damage at check-in and charge renter accordingly.
C. During Agent’s custody of the rental vehicle, Owner authorizes Agent to maintain the vehicle in good repair and in an attractive condition. The cost of maintenance will be paid by the money earned from the rental fee charged to the renter. Owner also authorizes Agent to authorize emergency road repairs for renter, and Agent agrees to use reasonable discretion in authorizing such repairs. Wear and tear is expected on any rental unit and normal exterior and interior wear and tear is the sole responsibility of the Owner. In the event of burns in the upholstery or damage Agent is not responsible for repair of damaged area.
D. To have vehicle readily available for Owner’s use, without payment of rental fees, upon Owner’s advance oral request, provided such request does not conflict with previous customers reservations.
7. AGENT’S COMPENSATION
Agent shall receive 50% of the gross rental collection from customers. Owner further agrees that Agent may charge the rental customer with, housekeeping kits, or any other such amenities and Agent shall be entitled to 100% of such revenue.
8. OWNER’S COMPENSATION
Owner shall receive 50% of the gross rental collected from the customers, less any insurance fees. Any major repairs that need to be done will be covered by the extended warranty if applicable. Owner is responsible for the deductible. If the repair is not covered by extended warranty, Owner is responsible for 100% of the
repair cost. A detailed statement along with any compensation due owner will be mailed on the 30
of each month unless no rental activity. In the event there is a negative balance at any time during the month (amount owed to Agent) then owner agrees to remit such amount due by credit card or check within (5) days of notice.
9. TERM
This agreement shall be continuous for one year or until terminated by either party giving sixty days written notice. This agreement will automatically renew unless owner notifies agent within 30 days prior to the expiration.
10. BETTER BUSINESS BUREAU ARBITRATION
The parties agree to submit to binding arbitration through the Better Business Bureau any and all dispute arising under this agreement or any addendum thereto, and to abide by the rules or procedure and/or process as provided by the Better Business Bureau Rules for Arbitration.
11. STATEMENTS BY EMPLOYEES
To avoid any miscommunication or misunderstanding in the formulation or application of the terms of this agreement, it is expressly understood and agreed that any statements relating to the effect of any part of this contract or made to induce the Owner to enter into this agreement by any employee of Agent is of no affect unless reduced to writing and included as part of this agreement either by interlineations (with such interlineations being initialed by both parties) or by separate addendum (signed by both parties). It is expressly understood and agreed that this agreement constitutes the complete and total agreement of the parties, and all prior written or oral agreements are deemed merged or superseded by the execution of this agreement.
